Interestingly, the decision did not really break down on ideological lines. Both Trump and Obama have expressed support for this kind of measure. And the court’s conservative bloc supported this decision, but so did Ruth Bader Ginsberg. John Roberts was against it.

Right. I don’t think that anyone is aiming for some kind of platonic ideal of “fairness,” because as you mention, that is impossible, as different businesses have different advantages. What this case is about, in my opinion, is how fairly the government tax regime treats different types of business.

It started out with Harry Winston. Trista (Rehn) Sutter had a Harry Winston three stone emerald cut that was smallish but very pretty. There were a couple of other named jewelers there between Winston and Lane. Neil Lane seems to have been the only one for quite some time. I am certain he recycles the same cushion cut diamonds repeatedly. Always with a bunch of melee on the band and in the ever present halo that I wish would just go away.

Consumers pay the tax…..retailers simply collect it and send it to the state. Consumers will now pay more for their goods. How much this helps or hurts business remains to be seen.

Therefore, to truly be fair (since that’s what’s important here…) should brick & mortar retailers be forced to not allow their customers to actually touch and feel a jewelry item? After all, this is a big advantage over e-tailers. Also, should they be forced to ship any purchased item to the buyer rather than simply allow the customer to walk out with the item? Another big advantage. Maybe they should no longer be allowed to speak to a potential customer face to face. Yet another advantage of brick & mortar retailers. Fairness is a apparently a very subjective concept.
